1. Service Description

BrandScanAI ("we", "us", "our", "the Service") is a web-based tool that analyzes how AI language models respond to prompts related to your brand. We generate prompts based on the brand name and industry you provide, send them to third-party AI models (including but not limited to ChatGPT, Claude, and Gemini) via API, and compile the results into a report.

2. Acceptance of Terms

By accessing or using BrandScanAI, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

3. Free Preview and Paid Reports

  • Free preview scan: You may run a free preview scan that sends 5 prompts to one AI model. The preview provides a limited summary (score, mention rate, top competitor). No payment or email is required for the preview.
  • Full report: The full report sends 20 prompts to 3 AI models and includes detailed analysis. It costs $29 USD per report (one-time payment, no subscription).
  • Payment is processed by our Merchant of Record, Creem (creem.io). By purchasing a report, you also agree to Creem's terms of service.

4. Important Disclaimers About AI Results

Please read these disclaimers carefully, as they describe fundamental limitations of the Service:

  • AI responses are non-deterministic. The same prompt sent to the same AI model at different times may produce different responses. Your report reflects a snapshot of AI behavior at the time of the scan and is not guaranteed to be reproducible.
  • Results are not endorsements or rankings. The visibility score and analysis we provide are based on our methodology for interpreting AI responses. They do not represent official rankings, endorsements, or positions from OpenAI, Anthropic, Google, or any AI provider.
  • We do not control AI model outputs. We send prompts to third-party AI models and analyze the responses. We have no control over what these models say about your brand or competitors.
  • No guaranteed outcomes. Purchasing a report does not guarantee any particular score, result, or business outcome. The report is an informational tool, not a guarantee of AI visibility or marketing performance.

5. Refund Policy

Because reports are generated and delivered instantly upon purchase, we generally do not offer refunds. However, if the Service fails to deliver your report due to a technical error on our end, please contact us at support@brandscanai.com and we will either re-generate your report or issue a refund.

6. Acceptable Use

You agree not to:

  • Use the Service to scan brands you do not own or have authorization to analyze in a way that violates any law.
  • Attempt to circumvent rate limits, bot protection, or payment verification.
  • Submit malicious, offensive, or illegal content as a brand name or input.
  • Resell, redistribute, or commercially republish reports without our written permission.
  • Attempt to reverse-engineer, exploit, or attack the Service.

We reserve the right to block access to any user who violates these terms.

7. Intellectual Property

  • The BrandScanAI website, design, and methodology are our intellectual property.
  • AI responses included in your report are generated by third-party AI models. We do not claim ownership of AI-generated text.
  • You retain all rights to your brand name and any trademarks associated with it.

8. Limitation of Liability

To the maximum extent permitted by law, BrandScanAI is provided "as is" without warranties of any kind, whether express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability is limited to the amount you paid for the specific report in question.

9. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. The Service depends on third-party AI model APIs which may experience downtime, changes, or discontinuation outside our control.

10. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms.
